Constitutionalism is the idea, often associated with the political theories of John Locke and the founders of the American republic, that government can and should be legally limited in its powers, and that its authority or legitimacy depends on its observing these limitations.
The term rule of law refers to a principle of governance in which all persons, institutions and entities, public and private, including the state itself, are accountable to laws that are publicly promulgated, equally enforced and independently adjudicated, and which are consistent and in conformity with the Constitution of the United States, the Amendments thereto, the intent of our founding fathers, and the core principals our Nation was founded on, ". . . and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation . . ."
Oligarchies are tyrannical, relying on public oppression to exist, while the rule of law implies that every person is subject to the law, including lawmakers, law enforcement officials and judges. In this man's opinion, the 10th Amendment - Reserved Powers ("The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people") speak loudest as it closes the circle around the other nine Amendments and the Constitution. Clearly it places States in a position to govern as they choose, only as long though as they do not violate the United States Constitutional rights of the citizens of the United States. Don't take a brain surgeon to figure this one out.
Fortunately, misinformation does not alter the truth, it just confuses the issues for some. The rest of us understand it.
